Definitions
The following definitions apply to these Terms and Conditions:
Cancellation Period: The period during which the consumer may exercise their right to cancel.
Consumer: A natural person who is not acting in the course of a professional or commercial activity and who enters into a distance contract with the business.
Day: A calendar day.
Ongoing Transaction: A distance contract involving a series of products and/or services for which the delivery and/or purchase obligations are spread over a specified period.
Durable Medium: Any medium that allows the consumer or the business to store information addressed personally to them in a way that makes it accessible for future reference and allows it to be reproduced without alteration.
Right to Cancel: The consumer’s right to withdraw from the distance contract within the applicable cancellation period.
Business: A natural person or legal entity that offers products and/or services to consumers through distance selling.
Distance Contract: An agreement entered into through an organized distance-selling system for products and/or services, in which one or more methods of remote communication are used exclusively until the contract is concluded.
Remote Communication Method: A method that allows a contract to be entered into without the consumer and the business being physically present in the same location at the same time.
Terms and Conditions: These Terms and Conditions of Bella Toronto.
Applicability
These Terms and Conditions apply to all offers made by Bella Toronto and to all distance contracts and orders entered into between Bella Toronto and the consumer.
Before a distance contract is entered into, the text of these Terms and Conditions must be made available to the consumer. Where this is not reasonably possible, the consumer will be informed where these Terms and Conditions can be reviewed, and they will be provided free of charge upon request.
When the contract is entered into electronically, these Terms and Conditions may be provided electronically in a format that allows the consumer to save them on a durable medium.
Where additional terms apply to specific products or services, the provisions above will also apply. In the event of a conflict between multiple provisions, the consumer may rely on the provision that is most favourable to them.
If one or more provisions of these Terms and Conditions are cancelled, invalidated, or declared unenforceable, the remainder of the agreement will remain valid. The affected provision will be replaced by a valid provision that reflects the original purpose as closely as possible.
Situations not specifically addressed in these Terms and Conditions will be interpreted in accordance with the intent and purpose of these Terms and Conditions.
The Offer
If an offer is available for a limited period or is subject to specific conditions, this will be clearly stated.
Offers made by Bella Toronto are non-binding. Bella Toronto reserves the right to change or modify its offers at any time.
Each offer will contain a description of the products and/or services that is as complete and accurate as reasonably possible, allowing the consumer to properly assess the offer. Images will represent the products and services as accurately as possible. Obvious or identifiable errors in an offer will not be binding on Bella Toronto.
All images, specifications, and information are provided for informational purposes only and do not create a right to compensation or order cancellation.
Each offer will also provide information that clearly explains the consumer’s rights and obligations, including:
the price, excluding customs duties, brokerage fees, and applicable import taxes, which are the customer’s responsibility;
delivery costs;
how the agreement will be entered into;
whether a right to cancel applies;
payment, delivery, and performance terms;
the period during which the offer remains valid;
any costs associated with the use of remote communication methods;
the language in which the agreement may be entered into;
any applicable codes of conduct and how they may be reviewed;
the minimum term of the agreement in the case of an ongoing transaction.
Available options may include sizes, colours, and material types.

Cancellation Policy
Customers may cancel their order within five minutes after receiving their order confirmation. After this period, orders are automatically processed and can no longer be cancelled.
All cancellation requests must be submitted through customer service.
By placing an order, the customer acknowledges and accepts this cancellation policy.
Right to Cancel
The consumer may cancel the agreement without providing a reason within 14 days, beginning on the day after the product is received.
The product must be handled with care and returned in its original condition and original packaging, together with all accessories and in accordance with the instructions provided by Bella Toronto.
Notice of cancellation must be submitted in writing or by email, and the product must be returned within 14 days after the notice is provided. The consumer must provide proof of shipment.
Costs in the Event of Cancellation
The consumer is responsible for all return shipping costs.
The refund will be issued no later than 14 days after the returned product has been received or after complete proof of shipment has been provided.
Exclusions from the Right to Cancel
The right to cancel may be excluded for:
personalized products or products manufactured according to the consumer’s specifications;
products of a personal nature;
perishable products or products that may deteriorate quickly;
products whose prices depend on fluctuations in financial markets;
individual newspapers and magazines;
audio or video recordings or software where the seal has been broken;
hygiene products where the seal has been opened.
For services, the right to cancel may be excluded for:
accommodation, transportation, food-service, or leisure activities provided on a specific date;
services that have begun, with the consumer’s consent, before the end of the cancellation period;
betting and lottery services.
Prices
The prices stated in the offer will apply, subject to any additional charges disclosed to the customer.
Price increases may result from changes to applicable federal or provincial sales taxes or from financial fluctuations outside Bella Toronto’s reasonable control.
All prices are subject to printing and typographical errors. No rights may be claimed as a result of such errors.
Where applicable, customs duties, brokerage fees, and federal or provincial sales taxes may be collected by the shipping carrier upon delivery.
Conformity and Warranty
Bella Toronto warrants that its products and services will conform to the agreement and the offer and will meet reasonable standards of reliability and fitness for use under applicable Canadian law.
Defects must be reported within 14 days after delivery.
The warranty does not apply where products have been modified without authorization, used improperly, exposed to abnormal conditions, or damaged through negligence.
Delivery and Performance
Delivery will be made to the address provided by the consumer when placing the order.
Accepted orders will be fulfilled within a maximum of 30 days unless otherwise agreed.
If delivery of an ordered product becomes impossible, Bella Toronto will make reasonable efforts to provide a replacement product. In this situation, Bella Toronto will be responsible for the return shipping costs.
Duration of Transactions, Cancellation, and Renewal
Cancellation
The consumer may cancel an agreement entered into for a fixed or indefinite period in accordance with the agreed terms, subject to a maximum notice period of one month.
Renewal
Fixed-term agreements may not be automatically renewed, except in limited circumstances involving newspaper or magazine subscriptions, and only for a maximum additional period of three months.
Duration
For agreements with a term longer than one year, the consumer may cancel the agreement at any time by providing one month’s notice.
Payment
Unless otherwise agreed, payment must be made within seven days after the cancellation period begins.
The consumer must report any errors in the payment information provided.
In the event of non-payment, Bella Toronto reserves the right to charge reasonable costs associated with collecting the outstanding amount, subject to applicable law.
Complaint Procedure
Complaints must be submitted within seven days after the issue is discovered.
Complaints will be answered within 14 days. Where additional processing time is required, the consumer will receive confirmation that the complaint has been received, together with an estimated response period.
Disputes
Agreements between Bella Toronto and the consumer will be governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Any consumer rights or remedies provided by mandatory applicable legislation will remain unaffected.
